GENERAL

This website, www.tessingtons.com (“The Website”), is owned and operated by Tessingtons Ltd. Registered office and details can be found below.

By using The Website, you agree to be legally bound by these terms, which shall take effect immediately on your first use of The Website. Should you not wish to be legally bound by all the following terms, please do not access and/or use The Website.

Orders placed The Website on are an offer to us to purchase goods from us. All orders are subject to acceptance by us which will be in the form of an email (Order Confirmation Email) to you confirming your order has been accepted, or otherwise confirm your order to you. The contract (Contract) between us is thus formed and completed when the goods are delivered, subject to these Terms & Conditions.

The Contract relates only to the goods whose dispatch we have confirmed in the Order Confirmation Email. We are not obliged to provide any other goods which may have been part of your order until the order of such goods has been confirmed in a separate Order Confirmation Email.

Tessingtons Ltd reserve the right to amends these Terms & Conditions from time-to-time. These Terms & Conditions and any Contract are available in the English language only.

To the maximum extent permitted by law, Tessingtons Ltd accepts no liability and shall not be responsible, whether in contract, tort, breach of statutory duty or otherwise, for any losses or damage, whether foreseen, foreseeable, known or otherwise including but not exclusively direct, indirect, consequential, special or exemplary, however they may arise.

ACCESS

Access to The Website is for your own personal and non-commercial use only and in accordance with these Terms & Conditions.

The following are prohibited uses of The Website including, but not limited to, its contents: downloading or modifying, interfering or disrupting any network connected to The Website, gaining unauthorised access to computer systems owned by, or used by, Tessingtons Ltd, any purpose which is unlawful, data mining or using data-gathering tools, framing techniques to add, remove or otherwise distort The Website, link to or use any trademarks, logos, designs or content

The Website is provided “as is” and accessing The Website is done so entirely at your own risk. No warranty is provided that The Website, including its content, or any functions of the server, will continuously operate without interruption, delay, error, defect free, without viruses or bugs or be compatible with any other software or hardware.

You are solely responsible for compliance with any and all local laws, where applicable, when choosing to access The Website.

PRICING

Every care is taken to ensure goods are priced correctly on The Website, but occasionally pricing errors may occur. In the event a pricing error occurs on good(s) that you have ordered, a member of our team will contact you and you will have the option to reconfirm your order at the correct price or to cancel.

Prices of goods may change from time-to-time and goods may be withdrawn at any time. Prices are inclusive of UK VAT where applicable but do not include delivery costs which will be added, in addition, at checkout.

Payment for all goods will be taken at time of ordering and you undertake that the details you provide to us when ordering or purchasing goods are correct and that the payment method used is your own and you have sufficient funds to cover the costs you will incur.

PRODUCTS

The imagery, descriptions, colours, specifications, dimensions, ingredients and other such content of goods are provided as accurately as possible and no guarantees are made as to their accuracy. We reserve the right to vary any and all content on The Website without prior notice. Photographs are for illustrative purposes only and may not contain shots of the actual tea or tea bag(s) in question and colours differ from computer to computer so products may have variances when purchased. Tessingtons Ltd are not responsible for the accuracy of photographs on the website and this is not considered a reason for return.

RIGHT TO CANCEL

You have the right to cancel your order, without cause, within a 14-day period from the day on which the goods are delivered to you.

You may cancel during this 14-day period by notifying us using our cancellation form here and returning the good(s) to the address provided by our team. Goods should be returned no later than 14-days from the day on which you cancel. Postage will not be reimbursed for returned goods. You are responsible for any and all costs associated with the return and the risk remains yours until the goods are received by us. This does not affect your statutory rights.

RETURNS

You have up to 30 days from the despatch date in which to return any goods to us for any reason. Goods must be in a saleable condition, in their original, undamaged, packaging and unused and undamaged.

A refund or replacement product will be offered.

Delivery charges will only be reimbursed in the event goods are faulty, damaged or the incorrect goods where sent to you. This does not affect your statutory rights.

We are unable to refund, cancel or exchange items that have been made to your specification and/or personalised, perishable goods unless faulty or damaged.

You must enclose the completed return form when returning any goods. Failure to include the completed return form may mean we are unable to identify the order and, therefore, may be unable to process the refund or exchange.

Tessingtons Ltd cannot be held responsible for any delays to refunds or exchanges if items are sent to the incorrect address, failure to include a completed return form or items outside of Tessingtons Ltd control including items lost by your chosen courier for a return.

The costs associated in returning items is down to you, the customer, as is the responsibility for any returned goods until they are accepted by us. It is recommended you obtain Proof of Postage when returning goods. Postage for returned goods that are faulty, damaged or sent in error, will be refunded to you. Postage costs for returned goods outside of the United Kingdom cannot be refunded.

PROMOTIONS & DISCOUNTS

Tessingtons Ltd cannot be held responsible for not discounting any order or applying any promotion if a relevant, valid code has not been entered and accepted in the relevant area of The Website.

Offers cannot be used in conjunction with any other offers and, unless otherwise stated, offers can be used only once and apply to only one household.

JURISDICTION

Contracts through The Website are governed by English law and are under the non-exclusive jurisdiction of the courts of England and Wales.

DELIVERIES TO THE UNITED KINGDOM

Our delivery partners are Hermes and Royal Mail.

We aim to prepare and despatch orders placed before 11am on the same day (Monday to Friday excluding UK bank holidays) and delivery is estimated at one to four working days from date of despatch.

Next day delivery is available to certain UK postcodes only on orders placed prior to 11am, Monday to Thursday (excluding UK bank holidays). Orders received after 11am on Thursday and pre 11am on Friday will be despatched on Friday for delivery the following Monday (excluding UK bank holidays). At no time can we guarantee any delivery times, whether your order was placed before 11am or after.

Tessingtons Ltd will use all reasonable endeavours to ensure the times detailed here are adhered to but cannot be held responsible for delays by third parties or unexpected events such as global pandemics.

If your order is returned to us owing to failed delivery attempts, non-collection or incorrect address we cannot refund any shipping costs.

Some orders may be subject to additional shipping charges. Any additional charges will be discussed with you prior to the despatch of your order.

We are unable to ship any orders to PO Boxes.

Deliveries to BFPO address are charged at the standard UK rates. If you have any issues entering your BFPO address, please contact us and we’ll be happy to help.

Any items damaged in transit will be exchanged, without charge to you, provided you return the damaged item(s) to us within 30 days of taking delivery. Please note that exchanges are subject to stock levels and we may not always be able to supply like-for-like exchanges.

Any items that are faulty should be returned to us within 28 days, along with proof of purchase, for a refund or exchange. Please note that exchanges are subject to stock levels and we may not always be able to supply like-for-like exchanges.

If you receive an incorrect item, please notify us as soon as possible, within 28 days and return the item to us, specifying the correct item in writing. Subject to stock levels we will provide the requested item as soon as possible. Any additional product or delivery charges will be discussed with you prior to the despatch of the requested item. We must receive the returned, incorrect item, prior to being able to provide any form of refund or exchange.

International deliveries may be subject to import duties, taxes and/or fees, of which we have no control, which are levied once goods reach the specified destination. You (the customer) are responsible for any import duties, taxes or other such fees incurred on your purchase. For exported items the carriage charge covers packaging and delivery only. For any items you order, you (the customer) are considered the importer and must comply with any and all relevant regulations of the destination country. You should contact your local customs office for further information. Should any additional charges go unpaid, customs may destroy or return the package to us and we will be unable to refund any shipping costs. There may also be costs borne by us for the return of goods and these will be deducted from any refund value you may be eligible to. Any items destroyed by customs are not eligible for any product or shipping refunds.

Any cross-border deliveries are subject to inspection (opening) by customs and Tessingtons Ltd are unable to provide any guarantees that goods will arrive in the same condition they were dispatched and are unable to offer product or shipping refunds in these situations.

Some countries have limitations on what can be sent, both goods, ingredients and value, and may require documentation, specific to your country, for clearance of your order. It is the customers responsibility to ensure any items adhere to relevant customs regulations, Tessingtons Ltd are not responsible for assessing these items and we suggest you contact your local customs office for the relevant information prior to placing an order. Should any additional charges go unpaid, or documentation not be in place, customs may destroy or return the package to us and we will be unable to refund any shipping costs. There may also be costs borne by us for the return of goods and these will be deducted from any refund value you may be eligible to. Any items destroyed by customs are not eligible for any product or shipping refunds.

SUBSCRIPTIONS

Our Subscription services are available to registered customers only and are available for six or 12 month periods.

Subscription services start on the 1st of each month (Subscription) though payment is taken immediately upon purchase (Payment Subscription Date). Your Subscription will begin on the following 1st day of the month subsequent to your Payment Subscription Date. E.g. sign-up on the 14th of month on, your Payment Subscription Date, and your Subscription will be begin on the 1st of month two, your Subscription date.

Subscriptions will auto-renew for the same period you originally subscribed for (six or 12 months) on the date of your Payment Subscription Date plus the period of time you subscribed for (six or 12 months).

Subscriptions are sent on the 1st of each month, where that day falls on a UK Bank Holiday they will be sent on the next available day.

Payment must be made upfront, in full, for each price plan. If your payment or renewal is unsuccessful your Subscription will not be processed or renewed.

Subscription users must have a valid Credit or Debit card on file in their My Account area in order to renew a Subscription.

You may cancel your Subscription at any time. If you cancel during a Subscription whereby you have paid in advance you will continue to receive your Subscription until the agreed six or 12 months’ worth of Subscriptions have been sent.

For cancellations purposes your Subscription runs on your Payment Subscription Date, not the date your Subscription is sent. If you cancel between your Payment Subscription Date and your Subscription renewal date the Subscription will renewal and the cancellation will come into force on your subsequent Payment Subscription Date.

You have the right to cancel your Subscription, without cause, within a 14-day period from the day on which the goods are delivered to you.
